Auctions are held to fulfil the requirements of Article 62 of the Law of Ukraine "On the Electricity Market", in order for the electricity market entities to perform special duties to ensure the public interest in the process of functioning of the electricity market Regulated by Regulation No. 483

Sellers at such an auctions are:

• Producers of electricity to which the respective responsibilities have been assigned (SE NAEK Energoatom and PJSC Ukrhydroenergo)

Buyers at the auctions are:

• Guaranteed buyer
• USS
• TSO

According to paragraph 6 of part two of article 66 of the Law of Ukraine "On Electricity Market", producers of electricity are state enterprises, as well as business companies, the state share in the authorized capital of which is 50% or more, business companies, in the authorized capital of which 50% or more shares (shares, stock) belong to other business entities, where the state is a shareholder and owns a controlling stake in them, as well as subsidiaries, representative offices and branches of such enterprises and companies conduct electricity sale under bilateral Contracts at the electronic auctions, the procedure on its conduction is approved by the Cabinet of Ministers of Ukraine. On implementation of the aforementioned provision of the law Resolution No. 499 of the Cabinet of Ministers of Ukraine of 5 June 2019, the Procedure for conducting electronic auctions for the sale of electricity under bilateral Contracts (hereinafter, the Procedure) was approved. Thus, it is worth noting that according to the provisions of the Procedure, the document regulating the procedure of interaction between the organizer of the auction and participants of the auction, defines the sequence of actions, terms, procedure and form of their performance during organization and holding of auctions, as well as measures to manage the risks of non-compliance ( failure) of auction participants with the requirements of the Procedure is the auction Regulations developed and approved by the organizer of the auction and agreed by the Auction Committee.

Sellers of the auction are:

• Producers of electricity are state-owned enterprises, as well as economic entities in which the state owns 50 % or more of the authorised capital, economic entities in which 50 % or more of the shares (shares, stock) are owned by other economic entities in which the state is a shareholder and has a controlling stake, as well as subsidiaries, representative offices and branches of such enterprises and companies and other electricity market participants other than the transmission system operator and distribution system operator who are intended to sell electricity in accordance with the auction requirements;
• Other sellers are electricity market participants who participate in auctions on a voluntary basis.

The Buyers at such an auctions are:

• Electricity suppliers
• Traders
• Consumers

• Other Buyers - electricity market participants participating in auctions on a voluntary basis

Sellers at such an auctions are:

• State owned, private electricity producers and others on a voluntary basis

Buyers in such auctions are:

• Legal entities with 100 %t of the shares owned by the State
