According to the current legislation of Ukraine, an organized commodity market can function exclusively as a commodity exchange with the functions of carrying out exchange and over-the-counter market (OTS) operations.
In order to implement the Decree of the Cabinet of Ministers of Ukraine dated December 30, 2021 No. 1433 "On approval of the list of types of products traded exclusively on organized commodity markets", the Ukrainian Energy Exchange has developed a mechanism for carrying out OTC transactions, which consists in registering OTC contracts.
OTC operations on the UEEX are carried out by reporting in accordance with the Rules for OTC Operations on the Commodity Exchange - Ukrainian Energy Exchange Limited Liability Company.
Over-the-counter transactions are carried out with products that are traded exclusively on organized commodity markets, as well as with other products defined by the Law of Ukraine "On Commodity Exchanges".
Registration of agreements and information about their implementation by reporting takes place in the information system of the Electronic Reporting Register (ERR).
Agreements are subject to registration, the subject of which is the transfer of ownership or obligations to transfer ownership of products, the volume of which is at least 20 tons. The responsibility for reporting lies with the buyer (for import operations) and the seller (for operations in the domestic market).
